In order to deliver NHS primary care services, medical, dental, and ophthalmic practitioners must be registered with a licence to practise with their respective professional regulator and listed on the Performers List of the country in which they wish to practise. The England Performers Lists are held by NHS England.
A practitioner wishing to work in NHS primary care in England must satisfy checks, equivalent to employment checks, as part of their application to be accepted on the Performers List.
There is a requirement for NHS England (or its agent, Primary Care Support England) to check for any relevant information held by NHS Resolution relating to the practitioner. Amendments to the National Health Service (Performers Lists)(England) Regulations 2013 in September 2023 require information to be requested as follows:
- whether NHS Resolution’s Primary Care Appeals service have received a Regulation 18 (notice of action on performers list inclusion) relating to the practitioner;
- whether there is any information held by NHS Resolution’s Practitioner Performance Advice service relating to the practitioner’s standard of practice or professional conduct of the practitioner other than in relation to a claim (this refers to Clinical Performance or Behavioural Assessments undertaken by NHS Resolution); and
- if there is any information held by NHS Resolution’s Practitioner Performance Advice service relating to an active Health Professional Alert Notice relating to the practitioner.
Please note that in Wales, it is the Primary Care Services Division of the NHS Wales Shared Services Partnership (NWSSP) who are responsible for the overall management of the Performers Lists, with initial performers list checks undertaken by the individual health board in conjunction with NWSSP.
