Primary Care Appeals has been the expert appellate body providing resolution in unresolved disputes between NHS service commissioners and NHS service providers for the last twenty-eight years. Wherever local resolution fails, Primary Care Appeal steps in to resolve disputes between NHS England and Improvement or clinical commissioning groups (CCGs) and service providers in general practice, dentistry, opticianry or pharmacy. It plays a critical role in achieving one major common goal: the maximisation of NHS resources to deliver the very best patient care.
Linked to its appellate work, Primary Care Appeals this spring published its approach to the award of interest on monies owed by primary care service commissioners or providers. This followed a Court of Appeal decision. The court found that we have the power to award interest when we find that a contractor has been underpaid or overpaid. Following the judgment, we have sought the views of key stakeholders such as NHS England and Improvement and representative bodies for general practitioners, dentists, community pharmacists and opticians to help inform our approach in the future.
